    This Note argues that had the Patterson Court considered the evidence of congressional intent and concern in its interpretation of section 1981, and had it placed more weight on policy considerations, it would have held that section 1981 prohibits racial harassment. The Note shows that, as decided, the Patterson decision will leave many victims of contractual racial harassment with an inadequate remedy, or with no remedy at all, because the closest alternative to section 1981, Title VII of the Civil Rights Act of 1964, is much less effective than section 1981, and because Patterson\u27s narrow construction of section 1981 deters the filing of employment discrimination claims. The result will be that racial harassment in the United States will be allowed to continue and increase

    Klebsiella pneumoniae is a leading cause of gram-negative bacterial pneumonia, often resulting in bacteremia concurrent with the localized pulmonary infection. The beneficial role of tumor necrosis factor (TNF)-alpha during pulmonary infection has been well documented; however, consequences of TNF-alpha production during systemic bacterial infection are controversial. A murine model of K. pneumoniae was developed to address this important issue. Liver-associated TNF-alpha mRNA was induced within 30 min after intravenous bacterial inoculation and remained elevated through 6 h before returning to near-baseline at 24 h postinfection. Intravenous K. pneumoniae infection induced liver cellular injury that was completely ablated when mice were pretreated with a neutralizing anti-TNF-alpha antibody. Interestingly, this reduction in liver injury failed to translate into improved survival. Mice receiving anti-TNF-alpha continued to succumb to the infection even out to day 10 postinfection. Bacterial clearance after TNF-alpha neutralization was significantly impaired at later time points during infection. Correlating with impaired bacterial clearance was diminished production of liver-associated MIP-2, MIP-1alpha, MCP-1, and interferon-gamma. Further evidence of diminished antibacterial immune responses was noted when the activational status of splenic natural killer cells in anti-TNF-alpha-treated mice was examined 24 h postinfection. Natural killer cells displayed decreased CD69 expression. Combined, these data indicate that the beneficial effects of TNF-alpha during systemic K. pneumoniae infection outweigh the detrimental effects of TNF-alpha-mediated hepatocyte cellular injury. Anti-TNF-alpha therapy, although preventing liver injury during blood-borne bacterial infection, results in a dampened anti-bacterial host response, resulting in decreased bacterial clearance and overall survival

    The Rural-Urban Continuum and Environmental Concerns

    Studies have generally found rural residents to be less concerned about environmental problems than urbanites. This difference has been attributed primarily to a nature-exploitative attitude of farmers. The present study finds little support for this proposition, but an alternative explanation, derived from rational choice and exchange theory, is supported. Owner-operator farmers are different from tenants and absentee owners in their level of environmental concern and shift positions across the range of environmental issues, as do rural nonfarm and small town residents. Furthermore, urban respondents are not consistently more likely than all rural categories to show the greatest environmental concern

    Nerve localization techniques for peripheral nerve block and possible future directions

    Ultrasound guidance is now a standard nerve localization technique for peripheral nerve block (PNB). Ultrasonography allows simultaneous visualization of the target nerve, needle, local anesthetic injectate and surrounding anatomical structures. Accurate deposition of local anesthetic next to the nerve is essential to the success of the nerve block procedure. Unfortunately, due to limitations in the visibility of both needle tip and nerve surface, the precise relationship between needle tip and target nerve is unknown at the moment of injection. Importantly, nerve injury may result both from an inappropriately placed needle tip and inappropriately placed local anesthetic. The relationship between the block needle tip and target nerve is of paramount importance to the safe conduct of peripheral nerve block. This review summarizes the evolution of nerve localization in regional anesthesia, characterizes a problem faced by clinicians in performing ultrasound guided nerve block and explores the potential technological solutions to this problem

    In Whose Backyard?: Concern About Sitting a Nuclear Waste Facility

    Proponents of hazardous and nuclear waste depositories label opponents to local siting of such facilities NIMBYs (Not In My Backyard). This study assesses the extent to which the NIMBY label and the strategies of industry proponents to reduce opposition function on a reasonable set of assumptions. Using survey data and multiple regression techniques, the levels of concern of residents living in the county selected as the site of a low level radioactive wane disposal facility (imminent threat condition) are compared with a statewide sample (hypothetical threat condition). Consistent with proponents\u27 theoretical assumptions, the levels of concern are greater for respondents under conditions of imminent threat than of hypothetical threat. However, within the host county, levels of concern are lowest, albeit most polarized, in the community closest to the proposed site. A conflict theory approach enhances an understanding of these findings by suggesting that within the most proximate community levels of concern are lowest for citizens who stand to gain the most economic benefits from the facility but highest for those citizens who are least likely to derive tangible gains

    Real-time flood inundation forecasting and mapping for key railway infrastructure: a UK case study

    Flooding events that impede railway infrastructure can cause severe travel delays for the general public and large fines in delayed minutes for the rail industry. Early warnings of flood inundation can give more time to implement mitigation measures which help reduce cancellations, delays and fines. Initial work is reported on the development of a real-time flood inundation forecasting and mapping system for the Cowley Bridge track area near Exeter, UK. This location is on one of the main access routes to South West England and has suffered major floods in the past resulting in significant transport impacts. Flood forecasting systems in the UK mainly forecast river level/flow rather than extent and depth of flood inundation. Here, the development of a chain of coupled models is discussed that link rainfall to river flow, river level and flood extent for the rail track area relating to Cowley Bridge. Historical events are identified to test model performance in predicting inundation of railway infrastructure. The modelling system will operate alongside a series of in-situ sensors chosen to enhance the flood mapping forecasting system. Sensor data will support offline model calibration/verification and real-time data assimilation as well as monitoring flood conditions to inform track closure decisions

    Growth faltering in rural Gambian children after four decades of interventions: a retrospective cohort study

    Background Growth faltering remains common in children in sub-Saharan Africa and is associated with substantial morbidity and mortality. Due to a very slow decline in the prevalence of stunting, the total number of children with stunting continues to rise in sub-Saharan Africa. Identifi cation of eff ective interventions remains a challenge. Methods We analysed the eff ect of 36 years of intensive health interventions on growth in infants and young children from three rural Gambian villages. Routine growth data from birth to age 2 years were available for 3659 children between 1976 and 2012. Z scores for weight-for-age, length-for-age, weight-for-length, mid-upper-arm circumference, and head circumference were calculated using the WHO 2006 growth standards. Seasonal patterns of mean Z scores were obtained by Fourier regression. We additionally defi ned growth faltering as fall in Z score between 3 months and 21 months of age. Findings We noted secular improvements in all postnatal growth parameters (except weight-for-length), accompanied by declines over time in seasonal variability. The proportion of children with underweight or stunting at 2 years of age halved during four decades of the study period, from 38·7% (95% CI 33·5–44·0) for underweight and 57·1% (51·9–62·4) for stunting. However, despite unprecedented levels of intervention, postnatal growth faltering persisted, leading to poor nutritional status at 24 months (length-for-age Z score –1·36, 95% CI –1·44 to –1·27, weight-for-age Z score –1·20, –1·28 to –1·11, and head circumference Z score –0·51, –0·59 to –0·43). The prevalence of stunting and underweight remained unacceptably high (30·0%, 95% CI 27·0–33·0, for stunting and 22·1%, 19·4 to 24·8, for underweight). Interpretation A combination of nutrition-sensitive and nutrition-specifi c interventions has achieved a halving of undernutrition rates, but despite these intensive interventions substantial growth faltering remains. We need to understand the missing contributors to growth faltering to guide development of new interventions

    Multiple-scale interactions structure macroinvertebrate assemblages associated with kelp understory algae

    Aim: Kelp forests provide habitat and food that supports a high diversity of flora and fauna. While numerous studies have described macroinvertebrates associated with kelp blades, stipes and holdfasts, a key kelp forest microhabitat, epilithic understory algae, remains poorly studied. Here, we used a macroecological approach and artificial seaweed units (ASUs) to explore the effects of ocean climate, wave exposure and habitat complexity on understory algal associated macroinvertebrate assemblages within Laminaria hyperborea forests in the United Kingdom. Location: 9° latitudinal gradient along the north and west coasts of the United Kingdom. Methods: Replicate ASUs comprising four different habitat complexities were deployed under mature L. hyperborea at 2 sites (along a wave exposure gradient, separated by km) within each of 4 locations (separated by 100s km) nested within two regions (warm and cold, spanning 9° of latitude). After 5 months in situ, the ASUs were collected and macroinvertebrates were identified to species level and enumerated. Results: Habitat complexity and wave exposure both influenced macroinvertebrate assemblage structure, but results also showed clear effects of ocean climate, with macroinvertebrate assemblages differing between warm and cool regions, primarily driven by higher diversity and evenness in the warmer region and greater abundance in the cooler region. Main conclusions: Predicted warming and a shift to less complex turf-forming algal assemblages are likely to alter the structure of macroinvertebrate assemblages associated with understory algae, with potential implications for kelp forest food web dynamics
